Dear John,

Every effort is being made to protect the appearance and property values of the Olympus I Homeowners Association. The Board is charged with enforcing the CC&Rs and the OIHA Rules and Regulations. Toward this goal, every property within the 341 home development is reviewed on a monthly basis to identify and correct CC&R violations including maintenance issues.
 
It has come to the Board’s attention that your property is currently out of compliance with the CC&Rs. Please consider this your FIRST warning. During the latest neighborhood review, your property was cited for:

Please correct this situation within 30 days from the date of this letter. When the situation has been resolved, please sign the bottom of this form and return it to the OIHA Office. For your convenience, there is a mail dropbox on the Clubhouse gate. Once your form is returned, we will review your property and update our records.

The OIHA Board of Directors is very sympathetic to personal circumstances that result in CC&R infractions, and is willing to work with Homeowners who make a “best effort” to comply. However, please be advised that a $25 fine will be imposed after the 30 day period if you do not contact us or make the corrections identified in this notice. Repeated violations of the same restriction within 12 months of the first warning will constitute a successive violation. For clarification on fines, please refer to Page 8 of the OIHA Rules and Regulations document: General Fine Schedule.

Please call the OIHA Office if you have any questions. You are also invited to view our website and attend the next Board of Directors meeting to learn more about CC&R enforcement within the Association.

Re: Notice of Fine Assessment

Dear John,

On DATE, we sent you a Notice of Violation letter warning about the following property maintenance and/or CC&R violation(s):

We asked you to correct the CC&R violation within 30 days or contact us directly to negotiate a workable solution. More than 30 days have passed since we first contacted you and we still have not heard from you, nor has the violation been resolved.

A $25 fine has now been added to your account as specified in the OIHA Rules and Regulations, page 8:  General Fine Schedule. This fine is payable within the next 30 days. If you wish to object to the Board’s determination of the violation, you may request a hearing before the Board. We have enclosed a Procedures form explaining the review process.

Furthermore, if the CC&R violation is not corrected within the next 30 days, the next fine will double to $50. Please be advised that if the violation is not corrected a lien can be placed on your property.

Re: Notice of Fine Assessment

Dear John,

On DATE, we sent you a SECOND CC&R warning about the following property maintenance violation(s):

We asked you to correct the CC&R violation within 30 days or contact us directly to negotiate a workable solution.  More than 60 days have now passed since we first contacted you and we still have not heard from you, nor has the violation been resolved.

Please consider this your THIRD warning regarding the same CC&R violation.  An additional $50 fine has now been added to your account as specified in the OIHA Rules and Regulations, page 8: General Fine Schedule. We are very serious about enforcing the CC&Rs to protect the rights of all Homeowners. If the CC&R violation is not corrected within the next 30 days, the subsequent fine added to your account will be $250, and the account will be turned over to our attorney for our collection. A lien will be placed on your property for the unpaid fines and dues now totaling $AMOUNT and all associated legal fees.
